1. Oggetto e Ambito di Applicazione

I presenti Termini e Condizioni d'Uso (di seguito "Termini") disciplinano l'accesso e l'utilizzo del sito web beralabs.it, il download dei pacchetti software in formato .ZIP, l'accesso all'ambiente di test Live Demo (ospitato su beraesign.netsons.org) e l'impiego dei plugin WordPress/WooCommerce realizzati da BeraLabs (in particolare Profit Warden e COD Anti-Fraud for WooCommerce).

L'accesso al sito, il download dei software o l'utilizzo delle istanze demo comporta l'accettazione integrale dei presenti Termini da parte dell'utente.

2. Licenza Software dei Plugin WooCommerce (GPLv2 o Successive)

In conformità alla licenza GPL:

• L'utente è libero di eseguire il software per qualsiasi scopo (personale, aziendale o commerciale).
• L'utente è libero di studiare il funzionamento del software, modificare il codice sorgente e adattarlo alle proprie esigenze.
• L'utente è libero di ridistribuire copie del software, a condizione che qualsiasi lavoro derivato sia rilasciato sotto la medesima licenza GPL.

3. Download dei Pacchetti .ZIP e Buone Pratiche d'Installazione

Il download diretto dei pacchetti di installazione .ZIP (es. profit-warden-for-woocommerce.zip, woo-cod-antifraud.zip) è fornito a titolo gratuito.

• Backup Preventivo: Sebbene i nostri plugin siano sottoposti a test rigorosi e conformi agli standard di sviluppo WordPress e WooCommerce HPOS, raccomandiamo caldamente di eseguire un backup completo del database e dei file del proprio sito prima di qualsiasi installazione o aggiornamento in ambiente di produzione.
• Ambiente Staging: È sempre buona norma testare nuove versioni in un ambiente di staging o di pre-produzione prima del rilascio definitivo.

4. Condizioni d'Uso dell'Ambiente Live Demo

L'utilizzo dell'ambiente Live Demo è soggetto alle seguenti regole inderogabili:

• Scopo Dimostrativo: Il sandbox serve unicamente a testare le funzionalità, le schermate admin, i flussi di checkout e i report dei plugin.
• Divieto di Dati Reali: È severamente vietato inserire dati personali reali propri o di terzi, dati di carte di credito reali, numeri di telefono reali o qualsiasi informazione confidenziale. Utilizzare esclusivamente dati fittizi.
• Reset Periodico del Database: L'ambiente viene ripristinato automaticamente a intervalli regolari. Tutti i post, ordini di prova, configurazioni o dati inseriti dagli utenti vengono cancellati senza preavviso.
• Nessuna Garanzia di Uptime o Conservazione: BeraLabs non garantisce la disponibilità ininterrotta dell'ambiente demo né risponde della cancellazione di dati di prova generati durante la navigazione.
• Divieto di Abuso: È vietato qualsiasi tentativo di alterare l'infrastruttura server, caricare malware, backdoor, script malevoli o eseguire attacchi informatici (DDoS, brute-force, injection). Qualsiasi condotta illecita comporterà il blocco immediato dell'IP e la segnalazione alle autorità competenti.

5. Proprietà Intellettuale e Marchi

• Brand BeraLabs: Il logo BeraLabs, la grafica del sito, i testi descrittivi, i marchi e i contenuti redazionali pubblicati su beralabs.it sono di proprietà esclusiva di BeraLabs.
• Codice Open Source: Il codice sorgente PHP, JavaScript e CSS dei plugin rilasciati sotto GPL è regolato dai termini della licenza GNU GPLv2+.
• Marchi di Terze Parti: I marchi WordPress, WooCommerce, Meta, Google, Stripe, PayPal, WhatsApp e altri citati nel sito appartengono ai rispettivi proprietari legittimi. La loro menzione ha scopo puramente descrittivo di compatibilità e interoperabilità tecnica.

6. Esclusione di Garanzie e Limitazione di Responsabilità ("AS IS")

NELLA MISURA MASSIMA CONSENTITA DALLA LEGGE APPLICABILE, IL SOFTWARE, IL SITO WEB, I PACCHETTI .ZIP E L'AMBIENTE LIVE DEMO SONO FORNITI "COSÌ COME SONO" ("AS IS") E "COME DISPONIBILI" ("AS AVAILABLE"), SENZA GARANZIE DI ALCUN TIPO, ESPLICITE O IMPLICITE, INCLUSE, A TITOLO ESEMPLIFICATIVO E NON ESAUSTIVO, GARANZIE DI COMMERCIABILITÀ, IDONEITÀ A UNO SCOPO PARTICOLARE, ASSENZA DI ERRORI O COMPATIBILITÀ CON QUALSIASI TEMA O PLUGIN DI TERZE PARTI NON TESTATO.

IN NESSUN CASO BERALABS, I SUOI SVILUPPATORI O COLLABORATORI SARANNO RESPONSABILI PER QUALSIASI DANNO DIRETTO, INDIRETTO, ACCIDENTALE, SPECIALE, CONSEQUENZIALE O PUNITIVO (INCLUSI, SENZA LIMITAZIONE, PERDITA DI PROFITTI, INTERRUZIONE DI ATTIVITÀ, PERDITA DI DATI AZIENDALI O MANCATI GUADAGNI) DERIVANTE DALL'USO O DALL'IMPOSSIBILITÀ DI USO DEL SOFTWARE, DEI PACCHETTI ZIP O DEL SITO WEB, ANCHE QUALORA BERALABS SIA STATA AVVISATA DELLA POSSIBILITÀ DI TALI DANNI.

BeraLabs si riserva il diritto di aggiornare o modificare i presenti Termini in qualsiasi momento. Le modifiche avranno efficacia a partire dalla loro pubblicazione su questa pagina. L'uso continuato del sito web o dei software a seguito della pubblicazione delle modifiche costituisce accettazione espressa dei nuovi termini.

8. Legge Applicabile e Foro Competente

I presenti Termini sono regolati e interpretati in conformità alla Legge della Repubblica Italiana. Per qualsiasi controversia derivante dall'interpretazione, validità o esecuzione dei presenti Termini, qualora non sia possibile raggiungere una risoluzione amichevole, sarà competente in via esclusiva il Foro di Roma, fatti salvi i fori inderogabili previsti dalla normativa a tutela dei consumatori ove applicabile.

Accessing our website, downloading packages, or using demo environments constitutes your unconditional acceptance of these Terms.

2. Software License for WooCommerce Plugins (GPLv2 or Later)

In accordance with the GPL license:

• You are free to run the software for any purpose (personal, commercial, enterprise).
• You are free to study how the software works and adapt source code to your specific requirements.
• You are free to redistribute copies, provided any derivative work remains under the same GNU GPL license.

3. ZIP Downloads and Recommended Deployment Practices

• Staging Environments: Testing new plugins in a dedicated staging environment prior to live deployment is considered best engineering practice.

4. Live Demo Usage Conditions

Live Demo access is subject to the following binding rules:

• Evaluation Only: The demo sandbox is designated exclusively to explore admin dashboards, order workflows, and plugin settings.
• Strict Prohibition on Real Data: You must never input real personal data, real credit card details, real phone numbers, or confidential assets. Use dummy test data only.
• Periodic Database Resets: The demo environment is automatically wiped and reset at recurring intervals. Any dummy orders, posts, or configuration entries will be permanently deleted without notice.
• No Uptime Warranty: BeraLabs provides no SLA or warranty for continuous availability of the demo sandbox.
• Abuse Policy: Any attempt to inject malware, upload web shells, perform brute-force attacks, or disrupt infrastructure will result in immediate IP blacklisting and criminal reporting to competent authorities.

5. Intellectual Property & Trademarks

• BeraLabs Assets: The BeraLabs brand, website layout, original copy, graphics, and documentation on beralabs.it are the proprietary intellectual property of BeraLabs.
• Open Source Code: PHP, JS, and CSS plugin source files released under GPL remain governed by GNU GPLv2+.
• Third-Party Trademarks: WordPress, WooCommerce, Meta, Google, Stripe, PayPal, WhatsApp, and related marks belong to their respective owners and are mentioned strictly to indicate technological compatibility.

6. Disclaimer of Warranties & Limitation of Liability ("AS IS")

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SOFTWARE, ZIP PACKAGES, WEBSITE, AND LIVE DEMO SANDBOX ARE PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR UNINTERRUPTED COMPATIBILITY WITH THIRD-PARTY PLUGINS.

Any legal dispute arising under or in connection with these Terms shall be submitted to the exclusive jurisdiction of the Court of Rome (Italy), subject to applicable mandatory consumer protection venues.
